Prohibition on import/export of certain goods

On March 8, 2022, the President of the Russian Federation signed an Executive Order, which prohibits the import and export of products and raw materials from the country according to the lists determined by the Russian Federal Government. According to the Executive Order, the ban and restrictions on the import and export of products and raw materials are applied “in order to ensure the security of the Russian Federation and the uninterrupted functioning of industry”.

The measures do not apply to Russians, foreign nationals and stateless persons in cases of import and export for personal use. The Government has two days to approve the list of foreign countries to which a ban or restriction on imports and exports from Russia will apply. The Executive Order enters into force from the date of its official publication – March 8, 2022.

No royalty payments to owners of patents from “unfriendly countries”.

On March 7, 2022, the Government of the Russian Federations published a Regulation, which allows not to pay compensation to owners of patents from unfriendly countries. The Chairman of the Government introduced amendments to the methodology for determining the compensation to be paid to the right holder when he decides to use an invention without his consent. According to the Regulation, with regard to the owners of patents from unfriendly countries the amount of payment is 0% of the actual proceeds from the production and sale of goods, performance of work and rendering of services, if the corresponding inventions, utility model or industrial design were used for this purpose.

The Regulation enters into force from the date of its official publication – March 7, 2022.
